How An Advocate Can Help

The term advocate is borrowed from the legal profession and used to describe the role of a person or group who assists other people in obtaining services and information that all citizens are entitled to.
An advocate provides leadership in articulating a client’s needs or requests - often challenging the medical, legal, and educational systems - in order to provide the client all necessary and entitled services.
Advocates can be found in parent support groups or employed in social service agencies. Certain professionals - such as lawyers and social workers - are trained specifically in the role of advocate.
Many social service agencies also fund or appoint advocates to work alongside staff in providing services to
specific groups. The mental health association and ARC in your area can provide trained advocates to
assist you.
Private advocates also are available but are generally expensive. They can be contacted through parent support groups and social service agencies.
If parents or guardians desire to become advocates, they should connect with other parents who have similar needs. Attending parent and professional seminars, being involved in parent support groups, and networking with other individuals in similar situations are important. Knowledge is power, and the more informed families are about their child’s needs and available services, the better advocates they will be.
Due to increased parental rights and safeguards in numerous pieces of legislation - such as the reauthorization in 2004 of IDEA (Individuals with Disabilities Education Act) - families now are in an ideal position to assume the role of advocate for their child.

How a Social Worker Can Help

Some people think social workers are found only in welfare offices and child abuse agencies. But you will find
social workers in almost any place where people have needs: hospitals, schools, counseling centers, adoption
agencies, private medical practices, and other human service agencies.
Social workers assist people from all walks of life to help them cope with the various stresses associated with
their situations.
Chances are there are social workers employed in facilities you have used (or anticipate using) for your child.
Social workers help people just like you.
How Do Social Workers Help?
1. First, they will assess the problem or need.
2. Second, they will determine - with the assistance of the client and other professionals - what the
appropriate plan of action should be.
3. Third, they will provide counseling and other direct services.
4. Fourth, they will link (or refer) clients to other services in their communities.
You’ll Find Social Workers In:
● Schools - with teachers and other professionals to help students and their families with various problems,
such as absenteeism; disruptive behavior; or emotional, personal, or social problems.
● Hospitals - counseling patients with serious illnesses and their families. Social workers help patients and
families work through emotional distress and find appropriate resources in the community that can provide
strength and encouragement. Here, the social worker is part of a team of physicians, nurses, and other health
care professionals.
● Counseling Centers and Private Medical Practices - offering individual, family, couple, and group
counseling or therapy to people who may be adjusting to stressful life situations, coping with illness, or
seeking personal growth. (Private counseling may need to be approved by your private insurer.)
How Do I Know if a Social Worker is a Professional?
The minimum qualification of a professional social worker is a BSW (Bachelor of Social Work) or an MSW (Master of Social Work) degree. A social worker also may be certified by the National Association of Social Workers (NACSW), which means he or she has an MSW, a minimum of two years experience in social work, and a passing grade on the NACSW exam. To be a Licensed Social Worker (LSW) in Pennsylvania, an individual must have an MSW and pass the state licensure exam.
How Do I Get In Touch with a Social Worker?

Medicaid Waivers
Support Services Waiver -- or simply “waiver” -- is a shortened term for the Medicaid Home and Community Based Waiver Program. This program provides funding for an array of services and benefits to individuals who might otherwise need institutional care.
The name “waiver” comes from the fact that the federal government "waives" Medical Assistance/Medicaid rules for institutional care in order for Pennsylvania to use the same funds to provide supports and services for people closer to home in their own communities.
In Pennsylvania, the Department of Public Welfare administers 12 Medical Assistance/Medicaid waivers and the Long Term Care Capitated Assistance Program. Each waiver has its own unique set of eligibility requirements and services. The individual must have limited income and assets in his or her own name. If eligible, the individual’s name is placed on a waiting list (which is usually long). Services are granted according to need and position on the list. Priority is given to individuals whose need for residential placement is critical, such as in the event of the death of a caregiver or closure of the institution where the individual resides. To apply, contact your county’s Mental Health/Mental Retardation office.
Types of Waivers:
AIDS Waiver
The AIDS Waiver provides home and community based services to eligible persons age 21 or older who have symptomatic HIV Disease or AIDS.
Attendant Care / Act 150
Information for mentally-alert Pennsylvanians with physical disabilities.
Autism Waiver
Pennsylvania has been approved for a first-of-its-kind federal waiver program to provide home and community based services specifically for adults with autism.
COMMCARE Waiver
Home and community-based program developed for individuals who experience a medically determinable diagnosis of traumatic brain injury.
Consolidated Waiver for Individuals with Mental Retardation
The Consolidated Waiver for Individuals with Mental Retardation provides services to eligible persons with mental retardation so that they can remain in the community.
Elwyn Waiver
The Elwyn Waiver provides community based services to eligible persons who are deaf, blind or deaf and blind, and who reside in the Valley View Facility or another residence in Delaware County.
Independence Waiver
The Independence Waiver provides services to persons with physical disabilities to allow them to live in the community and remain as independent as possible.
Infant, Toddlers, and Families Waiver
This waiver provides services to children from birth to age three in need of Early Intervention services who would otherwise require the level of care provided in an Intermediate Care Facility (ICF).
LIFE (Living Independence for the Elderly)
LIFE is a managed care program for frail elderly recipients who have been determined to need "nursing facility level of care" but wish to remain in their home and and community as long as possible.
Michael Dallas Waiver
The Michael Dallas Waiver provides services to eligible persons who are technology-dependent (i.e., requiring technology to sustain life or replace a vital bodily function).
OBRA Waiver
The OBRA Waiver provides services to persons with severe developmental physical disabilities, such as cerebral palsy, epilepsy or similar conditions.
Person/Family Directed Support Waiver
The Person/Family Directed Support Waiver provides services to eligible persons with mental retardation so that they can remain in the community.

Women, Infants, and Children (WIC) Program
Funded by the Pennsylvania Department of Health, WIC provides free food and nutrition education for eligible
women who are pregnant, breastfeeding, or who have given birth within the last six months, as well as foinfants and children ages birth-5 years. WIC is particularly helpful if your child is prescribed a special formula or
nutritional supplement.

Pennsylvania residents who meet income guidelines and have a nutritional or medical problem are eligible.
For example, as of 1998 guidelines, a family of four earning under $30,433 per year qualifies for WIC. All

Transportation
Added transportation safety measures may be required for some infants and children with medical conditions or disabilities. Following are information and resources concerning car seats; airbags; handicapped parking permits; car and van purchases and rentals; bus, train, and air transportation; Medical Assistance transportation; the Travel Training Program; and Driver’s Education classes. You also may want to consult your child’s physician, therapist, or the hospital discharge planner for any questions or concerns.

Car Seat Safety
The Pennsylvania state law - The Child Passenger Protection Act - requires that all drivers transporting children ages birth-4 years use an approved child passenger restraint system. Violators may be fined $25 plus fees and court costs. Older children must be secured with a safety belt. Children with medical conditions or disabilities may require special considerations or adaptions for transportation safety. A combination of education, planning, access to information, and appropriate safety devices will enable families to meet these needs.

Passenger Airbags
Airbags are lifesavers for adults but can be deadly for infants and children. An airbag can inflate with explosive force in a split second, even in low-speed, fender-bender accidents.
For this reason, all infants and children should ride in the back seat. However, some parents whose children have special medical needs (e.g., tracheostomy or an apnea monitor) are uncomfortable with their child being out of sight and reach. The best solution is to have another adult in the car who can sit next to the child. If this is not possible, parents can purchase a special mirror that allows the driver a good view of the child. These mirrors are available from major retail stores that sell toys and other children’s products.
Parents who want their children to ride in the front seat should be sure the airbag is turned off. Some vehicles have switches for this; others require a mechanic’s assistance. Parents also should seek the advice of their child’s pediatrician before placing the child up front. The U.S. Department of Transportation urges that all children under the age of 12 ride in the rear seat. However, there may be times when this is not possible.
The following can help prevent airbag injury to an older child:
● Move the seat back as far as possible.
● See that the child is properly restrained.
● Have the child sit upright against the seat back.
● Do not permit the child to lean forward towards the floor, dashboard, or radio dials.
● Do not let the child fall asleep with the head or upper body falling forward.

“Handicapped” Parking Permits
Families whose children have special medical needs or disabilities may qualify for a “Handicapped” Parking Permit from the Pennsylvania Department of Transportation (PennDot). You can request a mirror tag (free of charge) or a license plate (currently $15). If you use more than one vehicle, you can order both - or use the mirror tag in both cars.

Purchasing or Renting an Accessible Van (or Specially Adapted Vehicle)

ACCESS Transportation Services

Medical Assistance Transportation Program (MATP)

Please note that it is necessary to register for the program before you or your child can use the service. To be eligible, you must have a valid Pennsylvania Medical Assistance (MA) Card and be an Allegheny County resident.. Transportation is provided only to medical services that are covered by MA.
Enrollment is a three step process
MATP will verify the client’s MA eligibility and complete the MATP Application (usually over the phone).
MATP will mail the client’s application for signature.
Clients must sign application and return it to the MATP Office.
MATP is required by law to provide the least costly transportation available, including public transportation, mileage reimbursement, or para-transit shared-ride system. Agency decisions about the type of transportation service are based on client’s physical and/or behavioral health condition, health needs, physicians’ recommendations, and availability of public transportation between the trip origination and destination.

Extended or Cross-County Travel
Air Travel
Before making your flight reservation, ask the airline about its policies regarding travel with small children. Explain that your child has special needs and/or will be using medical equipment. If your child needs a wheelchair, request a wheelchair runner. If you are making a connecting flight, ask the airline for added assistance. Check to see if full fare must be paid to guarantee a child’s seat.
Here are some other tips for safe air travel with children:
● For a child less than 20 pounds, use a rear-facing car seat.
● For a child 20-40 pounds, use a forward-facing car seat.
● For a child more than 40 pounds, use the airplane seat belt.
● Do not use a booster seat - these are unsafe on planes.
AMTRAK trains have special sleeping quarters (accommodating two people) designed for passengers with special needs. You may want to inquire if the dining car is located on the same level as your room.

Residential Care
There are times when parents or guardians decide that a child can benefit from care outside the home. Residential care - an alternative living arrangement - is one option.
Services can be provided on an as-needed, temporary, or permanent basis. A valuable source of information for these services is the 0ffice of Behavioral Health or Office of Mental Retardation/ Developmental Disabilities. The Service Coordinator (Office of Behavioral Health) or Independent Supports Coordinator (Office of Mental Retardation/Developmental Disabilities) assigned to your child will provide assistance in finding schools and organizations that best meet your child’s needs, and make you aware of available funding sources.
Placement is dependent on the needs of the child and the family’s wishes, as well as on the availability of openings within the school or organization. If you are not registered with a Base Service Unit, contact your county’s mental health/mental retardation association to find out which location serves your community. You also may contact the placement director at the residential care facility you are interested in. The director can answer your questions and send you a packet of information.

Knowing Your Rights
● Early Intervention
Early Intervention refers to a statewide system of services and supports designed to help infants and children
with, or at risk for, developmental delay or disability. Eligible infants and toddlers - birth-3 years - and their
families are entitled to Early Intervention services, including screening, multi-disciplinary evaluation, on-
going assessment, and the development of an Individualized Family Service Plan (IFSP). All essential
services, plus transportation, are identified in the IFSP.
The Pennsylvania Early Intervention System (PEIS) is implemented in compliance with the Pennsylvania
Early Intervention Service System Act - PA Act 212-1990 - and IDEA (Individuals with Disabilities Education
Act) Amendments of 2004 under Public Law108-446, Part C. (See page 10 for more information on Early
Intervention.)

● Family and Medical Leave Act
The Family and Medical Leave Act of 1993 is a federal law that makes it possible for families to take up to 12
weeks of unpaid leave from their jobs in the event of a serious medical situation. The law applies to
companies that have at least 50 full-time employees, and guarantees that an employee on leave will be able
to return to his or her job - or a comparable one.
● The Americans With Disabilities Act
The Americans with Disabilities Act - or ADA - gives civil rights protection to individuals with disabilities. It
guarantees equal opportunity for individuals with disabilities in public accommodations, employment,
transportation, state and local government services, and telecommunications.

How to Find Help with Wills, Trusts, and Other Legal Concerns - Index
One important concern that parents and caregivers of children with special needs face is how to plan their estate to best provide for their child’s future security. According to the National Information Center for Children and Youth with Disabilities (NICHCY), parents often ask: What will our son or daughter do when we are no longer here to provide help when it’s needed? Where and how will our child live? Will he or she have enough money to sustain a decent quality of life?
In terms of estate planning, parents may wonder: How do I know what I am planning is going to work? Do I have enough money to hire a lawyer and write a will? Do I even have anything to leave my children?

Guidelines for Communicating about People with Disabilities
Put the Person First
It is important to identify the person first rather than the disability by saying a person with a disability or a person who is deaf, rather than a disabled person or a deaf person.
The terms afflicted with, suffering from, cripple, and victim are considered unacceptable because they emotionalize and sensationalize disability in a way that induces pity.
The phrase physically challenged is relentlessly cutesy and cheery. The word handicapped is derived from the image of a person with a disability who is on the street with a cap in his/her hand, begging for money — which implies this is all he/she is capable of doing. Except when citing law, regulations or environmental conditions (i.e., The stairs are a handicap to him or her), it is a less preferred term. Physical disability is the preferred usage.
Uses a Wheelchair - Not Is Wheelchair-bound
Say he or she uses a wheelchair, rather than is wheelchair bound or confined to a wheelchair. Without the use of a wheelchair the person would be confined or bound.
Blindness vs. Partial Vision
Blindness refers to a total loss of vision. Partial vision may be referred to as partial sight or visual impairment.
Deafness vs. Partial Hearing Loss
Deafness refers to a total loss of hearing. Partial hearing loss may be referred to as a hearing impairment.
Use Non-Verbal - Not Mute or Dumb
A person who cannot speak is the preferred phrase for describing individuals who are non-verbal. Terms such as deaf-mute and deaf-dumb are considered degrading, as well as giving the implication that all non-verbal persons are deaf, which may not be true. It also can imply that if someone is deaf, they must be unintelligent.
Use Congenital Disability - Not Birth Defect or Disease
A congenital disability has existed since birth. It may or may not be related to disease.
Use Learning Disability
A learning disability is a disorder affecting the understanding or use of spoken or written language.
Use Mental Illness or Mental Disorder - Not Neurotic, Psychopathic, or Schizophrenic
Mental disorder is a comprehensive term that describes any of the recognized forms of mental illness or severe emotional disorders.
Use Mental Retardation or Developmental Delay - Not Mentally Defective
Mental retardation or developmental delay is a condition causing a person to have significantly below-average general intellectual functioning. Labels such as mentally defective or deficient are unacceptable.
Use Speech Impairment
Speech impairment refers to limited or difficult speech patterns.
